ONG CHIN WEN from Butterworth, Penang. Received primary education in a crowded SRJK(C) in Butterworth. Continued secondary study in the sole SMJK in Butterworth - Chung Ligh High School Butterworth. Later, went to Skudai, Johore to pursue 1st Degree in Civil Engineering from University Technology of Malaysia (UTM). During which exposed to human rights issue and witnessed the Reformasi movement. Graduted from UTM but decided to take up law. Moved to Kuala Lumpur to work and managed to sturggle through the Law Degree study and the CLP examination in 4 years time. Moved back to hometown. Completed chambering and admitted to Malaysian Bar in September 2005. Now, a practising lawyer and active in People’s Justice Party (KeADILan), holding the post of Penang Deputy Youth Chief and Batu Kawan Division Youth Chief.

    Chin Wen, if possible, take away the visitor counter or set it with a higher number especially now in the critical period after parliment dismissed, maybe there will be supporters / voters to visit your blog, then it’s not proper to your image when the visitors number shown are too little.     I would like to share my problem with you Mr.Chin.

    I was terminated on 26th May 2006,(no in house union) but seeking help from MTUC. MTUC officer Mr K.Veeriah (Penang branch) advice me to launch a report at IR department in Penang no settlement reached during meeting on 4th July 2006 at IR dept with my employement and no representative from mtuc as well a cc copy send to mtuc(K.Veeriah) by IR department to be present for the meeting and personaly inform by me to Mr. K.Veeriah through calling to his handphone on 3rd July 2006 and promise given to me by the mtuc officer Mr K.Veeriah that he will attend the meeting on 4th July 2006.

    When I call Mr.K.Veeriah on 4th July 2006 around 830am to 930am regarding the meeting when the IR officer ask for my representative he told me that he forget about the meeting and he need to attend to his best friend mother funereal and ask me to proceed with the meeting.

    Suspected there are understanding between both party! (Employement and Mr K.Veeriah)

    Case has been referred to main office(Kementerian Sumber Manusia) on 28th August 2006.

    Received reply on June 2007 from Human Resources Minister regarding my termination on May 2006, after I referred my problems to Chief Secretary to Government YB Tan Sri Sidek Hassan.

    I launch the complaint to YB because the delay on feedback from HR department and all the consequences I face below.

    1) Pressured from bank
    2) Legal action
    3) House auction
    4) Medical expenses
    5) Family to support and daily expenses
    6) Jobless (terminated employee not hire by other employer)
    7) Blacklisted
    8) Soon (bankruptcy)
    9) Some intend to committe suicide!

    After the pressured given by YB Tan Sri to speed up and his involvement into my case make the Human Resources Minister unhappy with my complaint towards the Ministry and the Ministry came out with the reply within short period.

    The content of the letter is.

    Dimaklumkan bahawa Y.B. Menteri Sumber Manusia telah memutuskan di bawah Seksyen 20(3) Akta Perhubungan Perusahaan 1967, bahawa rayaun mengenai pembuangan kerja tuan tidak wajak dirujuk ke Mahkamah Perusahaan.

    After providing all the evidences to the IR department Penang the Ministry still came out with (tidak wajak dirujuk ke Mahkamah Perusahaan)

    Solectron management and the HR Ministry having a good understanding!

    Why the human resources minister takes so long to reply this?
    ( August 2006 - June 2007 )

    (The Star dated 2nd Sept 2007) most of the termination cases refer to Industrial court within 6 months claim by HR minister in Parliment!

    Whereas mine not necessary refer to industrial court takes more than 6 months after the pressure from YB

    FYI:

    Same management(Solectron Technology Sdn Bhd), similar case, terminated one month earlier then me (April 2006) and case has been refer to Industrial court.(Challenged by management will terminate me in one month time to the earlier terminated employee).

    Whereas my case was rejected from referring to Industrial court because I refer to YB?

    Where is the justice!

    How I am going to engage a lawyer because I am still jobless. Terminate employees will not hire by other employer unless provided with false information during the application.

    Can I get the justice?

    Who will help the innocent employees?
